We will need the user to agree to some Terms of Service that allow us to display their notes to them, and to display public notes to other users, etc.

Probably there are other things that I'm not thinking of right now.

See wordpress.com for openly licensed ToS that you can use (CC:BY-SA). A modified version is also used by identi.ca.

Note: you will need to change some of the language to meet your specific needs. I'm willing to help with this (and the privacy policy) as I've done it before for work.

Draft ToS text

Here's my first draft that will need feedback from the GNOME legal team and the devs.

(It is just in ODT right, now, I have a plain text version started but it isn't using the up-to-date language.)

So, some things specifically to address (most are highlighted in the doc):

1) (Preamble) Need a link to either the GNOME or Tomboy Online Privacy policy URL (see Snowy bug #613890 and GNOME Website bug #601843).

2) (sections 3 & 4) VIP Hosting/Services: As this was based on the Wordpress.com ToS they have a section on their Premium services they sell. Even if there are not immediate plans for a premium version of Tomboy Online this is OK to leave in as it won't really be saying much. Or, another choice is to leave it out for now and add in it when the need arises. This is mostly a legal team decision.

3) (section 7) DMCA agent. As there will be public notices that could potential provide infringing content, there should be a way for someone to file a DMCA takedown notice. See bug #631276.

4) (section 11) There is a joke in this ToS from Wordpress.com where it is a simple "if you've been reading this long, here's a treat" with a link to a cake. Totally optional.

5) (section 12) The highlighted part is only relevant is there is a Premium service (see number 2).

6) (section 15) The GNOME legal team will need to adjust this section as they see fit. This is mostly a "if you are going to sue us, you can to do it in this specific jurisdiction and this is how" section.


Let me know what feedback you have and I can incorporate it.

Snowy has not seen any code changes since October 2011:

This project is not under active development anymore and got recently archived
in GNOME Git.
It is currently unlikely that there will be any further active development.

Closing this report as WONTFIX as part of Bugzilla Housekeeping to reflect
reality. Please feel free to reopen this bug report in the future if anyone
takes the responsibility for active development again.
