When I minimise Empathy to tray using the notification area, and then click again to unminimise, Empathy's contact list will reappear in my window list, only to be minimised, which totally gets on my nerves.

Also, often it will appear at the other side of my desktop, which will make me move it across to its right place.

I see this behaviour too. Empathy 0.21.3 on Foresight Linux 1.4.2.

Update to 0.21.4 fixed this for me.

I have to correct this. The update came when I had compiz enabled so I thought that it was fixed. Without compiz Empathy shows the error again.
