when viewing as list, every right click will select a file/folder, which 
does not display the option to create a new folder in the right click menu.

This is indeed an issue, but I can't see a good way to fix it -
there's no place in the list view where you don't want to select a
file. Potentially we could separate out some sort of spacing between
the lines, but that causes other less useful problems. So, my vote is
WONTFIX. Can someone else either agree and close, or see a possible
solution? DaveB? :)

I think what can be done is making only right clicking the filename 
icon selects the file, other than that no file is selected, just like 
Konqueror.
