gnome-terminal 3.0.1 is always on top even with the "always on top" feature disabled, its even on top of the screensaver! You don't say which desktop environment you're using. If it's unity (wether 2d or 3d), this is an ubuntu problem. Please try to reproduce this with either gnome-shell or metacity as window manager (with compositing disabled!), and make sure you also disable the ubuntu global menubar and the ubuntu thin scrollbars. Reopen only if you can repro it in this configuration.
