Using Nautilus 2.12.0, I tried reproducing this bug.  I tried moving a blank file to the trash (by right-clicking the file), and I was not asked to confirm the move.  I checked in the configuration editor under nautilus preferences, and confirm_trash was set to true.  Setting the value to false also does not get nautilus to confirm a move to trash.

Since this bug has been resolved, I found out that the description of the functionality of confirm_trash in the configuration editor that I previously described is incorrect, so I submitted a new bug. The new bug is: 329440

So it was the description of the feature that was incorrect, rather than the feature itself.
