one can't create a tag at toplevel, but we can move a created tag at top level

I expect to be able to create a new tag at top level

Does this happen every time?

This bug is fixed by the same patch (and some code changes) that fix bug 165035.

Sorry, that should be *same* code changes, not some.

Also, I shouldn't have marked this as a duplicate as it's talking about tags,
not categories. Close enough (and the fix is literally the same) that I'll leave it.
