Nautilus keeps creating a new Desktop folder, when the home is set as desktop

Please describe the problem: I have my desktop set to be the home directory in gconf. Once I did this the ~/Desktop folder was displayed on my desktop. I emptied out the contents and deleted the folder. There is no reason why i should have this folder anymore as i would expect the ~/ dir to act just as the ~/Desktop previously did If i use my computer for a while It will suddenly come back for no apparent reason. I would expect it to stay deleted and all applications now treat ~/ as it would normally treat ~/Desktop I feel this is related to bug 133510 but still different Steps to reproduce: 1. in gconf set the desktop to be the home dir 2. Delete ~/Desktop 3. Use desktop normally and it will magically reappear Actual results: Expected results: The ~/Desktop should stay deleted and the system should now treat ~/ is it would have treated ~/Desktop Does this happen every time?
