Really I don't know if this is an empathy issue or a telepathy issue...

In ICQ protocol, an online but "invisible" contact is marked "offline" (instead of "online/invisible") despite the fact that the contact has the user in its "visible list"

The same contact is visible using pidgin, so I think that libpurple can handle this situation correctly.

OS: Ubuntu 9.04 (Jaunty)
Empathy v. 2.26.1 
Telepathy-haze v. 0.2.1-1

Note: due to lacking of support of "visible list" feature in any ICQ linux client, I think you need in your list a contact using official ICQ client to test this bug.
