Description:
When the main gnome panel is set with the "Don't avoid on 
maximize" setting the gnome panel is correctly NOT avoided when a
window is maximized.  But, the next time you log into the gnome desktop,
the setting is still set, but the panel IS avoided on window maximizes.
The only way to fix this is the unset the switch and reset it.

Hmmm I cannot reproduce this, can you provide more information about
what panel exactly and more details about your setup?
