I removed it because it wasn't really 'context' ...

How about adding it in the app menu ?

The problem is that the app menu won't be a good place if you have > 1 terminal window. The app menu is supposed to contain app-wide items, which obviously doesn't fit applications that have > 1 window.

I agree it's not really context but it was really useful to me.

Would showing the "Open New Tab/Window" menu items in the right-click menu only if the menu bar's hidden complete crack?

I'll just revert commit ed4292941183107ac698d4f469eaef8ea683bae1 . For 3.9, this will all be redesigned in a way that an app menu entry will make more sense.
