If you have keybindings or other customizations that allow you to maximize windows only vertically, then the maximize gesture for tiling is problematical because any attempt to move a window horizontally will likely trigger maximization.

We should just disable the maximize gesture for a window that is vertically maximized, even if it is not horizontally maximized.

Not sure what gestures this is about as pointer gestures came 3 years after this bug report. The drag-gesture doesn't have this problem with vertically maximized windows as far as I can tell, so closing as obsolete.
