It would be good to prevent windows from being partially obscured by the top menu bar in gnome shell.  First of all it breaks the metaphor that the top bar is negative space if something can slip underneath it.

Ideally the bar is at the top and left monitor.  If it is not (by explicit choice) then we could allow the window to pop across the boundary when it is moved far enough.  But we still shouldn't allow it to be bisected by the bar.

While I think you have a point, I’ve found myself often needing to drag a window under the top panel when working on a small widescreen monitor, like the ones used in netbooks, to reach some controls on a tall preference window.

So I think this behavior should not be removed; increasing the amount of force needed to slip a window under the top panel, on the other hand, would probably be a good idea.
