When you have an expanded list view with a folder selected, it makes sense for File/New Folder to create the new folder within the selected folder, rather than at the top level of the list view tree. Creating at the top level of the list view is annoying when you have quite a deeply nested tree, especially if the directory names are similar.

This is a usability change, and a small design change, rather than a bug.

I'm assuming that this would only apply for expanded folders?

If so, I like the idea but would amend this to say, "Create a new item at the same level as an item which is selected." (Since this can also apply to "Create Launcher..." and "Create Document" menu items.)

This would work and be logical in any view. Simply selecting a folder shouldn't create a new item within it. Else, what happens if in icon or compact views. Or in list view when folder is folded? Or in a list view filled with the contents of a single, unfolded folder?

If a new item appeared at the same level as the selected item, then it works for any level:

Given a tree structure in a list view as following,

A
B
  1
  2
  3
    a
    b
    c
C

Then,
1. Select "A", "Create XXX", new item is at same level as A, B, C
2. Select "B", "Create XXX", new item is at same level as A, B, C
3. Select "2", "Create XXX", new item is at same level as 1, 2, 3
4. Select "3", "Create XXX", new item is at same level as 1, 2, 3
5. Select "a", "Create XXX", new item is at same level as a, b, c
