The bug has been opened on https://bugs.launchpad.net/ubuntu/+source/nautilus/+bug/435387

"Restoring files from trash overwrites existing files without usual prompt. This can cause (already caused) permament loss of data."

Confirmed in 2.28

This is now fixed in gvfs master and gnome-2-28.
